Terms of service

As of: October 2026

§ 1 Scope and provider

(1) These General Terms and Conditions apply to all contracts between Teppex, Stefansbecke 6, 45549 Sprockhövel, Germany, represented by Jaber Mirzakhani (hereinafter the "Provider"), and the customer concluded through the online shop teppex.shop, in the version valid at the time of the order.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code, BGB). A business customer is a natural or legal person or a partnership with legal capacity who, when entering into the legal transaction, acts in the exercise of their trade, business or profession (§ 14 BGB).

(3) Conflicting terms of the customer do not apply unless the Provider expressly agrees to them in text form.

§ 2 Special characteristics of the goods

(1) Our range includes hand-knotted oriental rugs as well as hand-woven Kelim, Kelim bags and Kelim cushions. Most pieces are unique pieces. Antique and pre-owned pieces are marked as such.

(2) The description of the goods is determined by the information in the product description on material, dimensions, origin, condition and particularities, and by the photos on the respective product page. What is stated there is the agreed condition of the goods.

(3) Handwork and natural materials involve characteristics that are not a sign of poor quality. These include in particular slight colour variations in the yarn (abrash), minor asymmetries and irregularities in the pattern, deviations in size of usually a few centimetres from the stated dimensions, a natural wool smell and initial shedding. Colours may look different on screens depending on settings and photography. Such characteristics do not in themselves constitute a defect as long as the goods correspond to the product description.

(4) Antique and pre-owned pieces may show signs of age and use, patina and professional repairs. These are stated in the product description insofar as they are material. Statutory rights in case of defects remain unaffected (§ 7).

§ 3 Presentation of products and AI-edited images

(1) The presentation of the goods in the online shop is not a binding offer, but an invitation to the customer to submit an offer.

(2) Individual lifestyle images in the product gallery, on the home page and on collection pages have been edited or generated with AI. They serve as inspiration and do not show size relations, lighting or the effect in a room in a binding way. The main image (original photo) and the information in the product description are binding for colour, proportions and condition.

§ 4 Conclusion of contract

(1) The customer places the desired goods in the shopping cart and enters their address, shipping and payment details at checkout. Before completing the order, the checkout shows an overview of the goods, the total price and the shipping costs. By clicking the button that completes the ordering process, the customer submits a binding offer to purchase.

(2) The customer can recognise and correct input errors before completing the order in the checkout and in the shopping cart; entries can also be changed using the back function of the browser.

(3) For payment methods with immediate payment instruction (e.g. PayPal, credit card, Apple Pay, Google Pay), the contract is concluded upon the payment instruction. For other payment methods (e.g. prepayment by bank transfer), the contract is concluded when the Provider confirms the order by e-mail or ships the goods. The automatic confirmation of receipt is not yet an acceptance.

(4) Most goods are unique pieces. The conclusion of the contract is subject to the goods actually being available. If a piece has been sold or damaged in the meantime, the Provider will inform the customer without delay and refund any payments already made without delay.

(5) The Provider stores the contract text. The customer receives the order details and these T&C by e-mail; the T&C can be accessed in the shop at any time. The order details themselves are not accessible to third parties.

(6) The contract language is German. Translations of these T&C and other legal texts serve for understanding only; the German version prevails.

§ 5 Prices, shipping costs, customs duties and payment

(1) The prices in euros stated in the shop at the time of the order apply. For consumers, they are final prices including statutory value added tax, where applicable. For deliveries to countries outside the EU, no German value added tax is charged insofar as the delivery is exempt from value added tax as an export delivery; the total price shown at checkout is decisive.

(2) Delivery areas and shipping costs are set out in our shipping terms and are shown to the customer at checkout before the order is placed. The Provider does not charge any further shipping costs that are not shown.

(3) For deliveries to Switzerland, the United Kingdom, Norway, the USA and Canada, the customer bears the customs duties, import charges, import VAT and handling fees incurred in the country of destination (delivery term DAP).

(4) The payment methods shown at checkout are available to the customer.

(5) The goods remain the property of the Provider until payment in full.

§ 6 Delivery and transport damage

(1) The Provider delivers to the countries named in the shipping terms. Delivery to other countries, in particular Malta and Cyprus, is not made.

(2) Stated delivery times are estimates and not binding dates, unless a fixed date has been expressly agreed.

(3) If the customer is a consumer, the risk of accidental loss and accidental deterioration of the goods passes to the customer only upon handover of the goods to the customer or to a person authorised by them to receive them. If the customer is a business customer, the risk passes upon handover to the carrier (§ 447 BGB).

(4) We ask the customer to report transport damage on delivery to the carrier and to us without delay. If the customer fails to do so, this has no consequences for their statutory rights in case of defects as a consumer. The report does, however, help us to assert claims against the carrier.

§ 7 Liability for defects

(1) The statutory provisions on liability for defects apply, taking into account the condition described in § 2.

(2) If, for a unique piece, the delivery of an equivalent replacement is not possible, subsequent performance is limited to repair by professional restoration. If this fails or is impossible, the customer may, in accordance with the statutory provisions, reduce the price or withdraw from the contract.

(3) There is no claim for defects for damage that arises after the transfer of risk through improper handling, unsuitable cleaning or care, moisture, pets or mechanical overload by the customer.

§ 8 Right of withdrawal

(1) Consumers have a statutory right of withdrawal. The details, the model withdrawal form and the consequences of withdrawal are set out in our withdrawal notice. The withdrawal period is fourteen days; the customer bears the direct cost of returning the goods.

(2) The right of withdrawal does not exist for goods that are made to the customer's specifications or are clearly tailored to the consumer's personal needs.

§ 9 Liability

(1) The Provider is liable without limitation in cases of intent and gross negligence and for injury to life, body or health.

(2) In cases of slightly negligent breach of essential contractual obligations (cardinal obligations), the Provider's liability is limited to the foreseeable damage typical for this type of contract. Essential obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely.

(3) Otherwise, liability for slight negligence is excluded. Liability under the Product Liability Act and statutory claims under guarantees remain unaffected.

§ 10 Applicable law and place of jurisdiction

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they habitually reside.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is the Provider's registered office.

§ 11 Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 12 Severability clause

Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions remains unaffected. The statutory provision replaces the invalid provision.

The German version is binding.
